These Terms & Conditions apply to purchases made through the XANO website and to custom commissions. By placing an order or approving a commission, you agree to the terms below.

ORDERS & PAYMENT
Website OrdersAll in-stock and made-to-order website purchases must be paid in full at checkout.

Currency
Website prices are displayed in USD. For customers purchasing from Mexico, the final charge and currency conversion may vary depending on the payment method or provider used. Any exchange rates or foreign transaction fees are determined by the customer’s bank or payment provider.

Financing
For customers in Mexico, installment options through Mercado Pago, including Meses Sin Intereses when available, may be offered at checkout. Available plans, minimum purchase amounts, and eligibility are determined by Mercado Pago.

Order Changes & Cancellations
Because many XANO pieces are made to order, orders cannot be modified or cancelled once production has begun. Requests made before production begins may be considered on a case-by-case basis.XANO reserves the right to cancel or refuse an order in cases including pricing errors, inventory inaccuracies, or suspected fraudulent activity.

COMMISSIONS
Custom Commissions
All custom commissions, excluding Engagement & Commitment Commissions, require 100% payment before production or casting begins. A design and quote will be provided for approval before production starts.

Engagement & Commitment Commissions
Engagement and commitment commissions require a 70% deposit to begin the design process, stone sourcing, and production. The remaining 30% balance is due upon completion and approval of the final piece, before shipping.
Once design development, stone sourcing, or production has begun, the 70% deposit is non-refundable.

Timelines
Standard custom commissions typically require 15–30 business days for production, depending on the design and level of detail.
Engagement and commitment commissions typically require 1-3 months from the initial consultation to completion. This timeframe includes design development, revisions, stone sourcing, client approval, and production.
Timelines may vary depending on the complexity of the piece, availability of materials or gemstones, and the time required for client approvals.

Design Revisions
A design will be approved by the client before production begins. Changes requested after production has started may not be possible and, when possible, may result in additional fees and an adjustment to the original timeline.

Final Sale
Custom commissions and Engagement & Commitment Commissions are made specifically for each client and are therefore final sale, non-returnable, and non-refundable, except in cases covered by XANO’s Returns & Damaged Items Policy or where otherwise required by applicable law.

CUSTOMS & SHIPPING
Refused or Undeliverable International Orders
If an international package is refused, abandoned, or returned due to unpaid customs duties, taxes, or fees, any return shipping costs, carrier charges, customs clearance fees, or other costs charged to XANO may be deducted from any store credit issued to the client.

Repair Shipping
For repairs that fall outside XANO’s applicable warranty or defect coverage, the client is responsible for insured shipping costs to and from the XANO studio.

INTELLECTUAL PROPERTY
All original XANO designs, including custom designs, sketches, 3D models, photographs, graphics, website content, and other creative materials, remain the intellectual property of XANO.
Commissioning a piece does not transfer ownership of the underlying design or intellectual property to the client.
XANO reserves the right to photograph or share completed commissioned work for portfolio, website, or social media purposes unless otherwise agreed with the client.

LIABILITY
To the extent permitted by applicable law, XANO will not be liable for indirect, incidental, special, or consequential damages arising from the purchase or use of a XANO piece.
To the extent permitted by applicable law, XANO’s total liability for any claim relating to an order will not exceed the amount paid for the specific piece giving rise to the claim.

GOVERNING LAW
These Terms & Conditions are governed by the applicable laws of Baja California, Mexico. Any dispute arising in connection with these Terms will be subject to the jurisdiction of the competent courts in Baja California, Mexico, to the extent permitted by applicable law.

XANO reserves the right to update these Terms & Conditions when necessary. Any changes will be reflected on this page.
